DALLAS - The high court docket will permit a wrongful dying lawsuit to proceed towards the city of Dallas and four police officers.

The household of a person who died in police custody in 2016 sued.

Tony Timpa referred to as police for help as he had a drug and mental well being disaster.

The town fought towards releasing body camera video and whit it did come out it was obvious why. It showed the officers mocking the dying man.

One had his knee on Timpa’s again and neck for almost quarter-hour and the medical expert stated that contributed to his loss of life.

The town of Dallas argued the officers are legally protected against lawsuits.

The Supreme Court upheld a federal appeals court docket’s ruling that will enable the case to proceed.

"The choice implies that the case can proceed to trial and that there will likely be no extra delays from any appellate court. Additionally, the choice signifies that the Fifth Circuit did it right that their ruling relating to deadly power would be the regulation of the land a minimum of in Mississippi, Texas and Louisiana for as long as we know," stated Geoff Henley, an attorney for Timpa’s family.

These are the states coated by the Fifth Circuit Court docket of Appeals ruling permitting the suit to continue.

Three years in the past, the Dallas district lawyer dropped prison expenses against three of the officers.
